1. Acceptance of Terms

By accessing or using Permit Minder (permitminder.org), you agree to these Terms of Service. If you do not agree, do not use the platform.

2. Description of Service

Permit Minder is an informational platform that reformats and displays publicly available discharge monitoring data from the Pennsylvania Department of Environmental Protection (PA DEP) eDMR system. Permit Minder does not generate, verify, or independently confirm the accuracy of underlying government data.

3. No Regulatory Determinations

Permit Minder does not make legal or regulatory determinations. The appearance of a facility or data record on this platform does not mean the facility has exceeded any law, regulation, or permit condition. Exceedance data reflects reported values compared to permit limits on file and may not account for variances, consent orders, amended permits, reporting corrections, or other regulatory context.

4. No Legal Advice

Nothing on this platform constitutes legal, regulatory, environmental, financial, or investment advice. Consult qualified professionals before making decisions based on information obtained from Permit Minder.

5. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or timeliness of data. Permit Minder does not warrant that data is current, correct, or complete.

6. Limitation of Liability

To the maximum extent permitted by law, Permit Minder and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the service; (b) any data or information obtained from the service; or (c) any decisions made based on information from the service.

In no event shall Permit Minder's total liability exceed the amount you paid to Permit Minder in the twelve (12) months preceding the claim, except for liability that cannot be limited or excluded under applicable law.

7. Indemnification

You agree to indemnify and hold harmless Permit Minder and its operators from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the platform or any action taken based on data obtained through the service.

8. Data Accuracy and Timeliness

Permit Minder sources data from public government databases. Data is updated on a regular schedule but may not reflect the most recent submissions, corrections, or regulatory actions. Users should independently verify any information before relying on it for any purpose.

Permit Minder is not responsible for errors, omissions, delays, or inaccuracies in data sourced from the PA DEP eDMR system, EPA ECHO, or any other government source. Any dispute regarding the accuracy of underlying records must be raised with the originating agency.

9. User Accounts and Email Alerts

By providing your email address, you consent to receiving alert notifications related to your selected monitoring preferences. You may unsubscribe from alerts at any time using the unsubscribe link in any alert email. Permit Minder will not sell or share your email address with third parties.

10. Acceptable Use

You may not use Permit Minder to: (a) harass, defame, or threaten any person or entity; (b) misrepresent data obtained from the platform; or (c) scrape or bulk download data in a manner that degrades service performance.

Permit Minder LLC may suspend or terminate access for any user who violates these Terms, with or without notice.

11. Modifications

Permit Minder may modify these Terms at any time. Continued use after changes constitutes acceptance.

12. Governing Law and Venue

These Terms are governed by the laws of the Commonwealth of Pennsylvania without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or to your use of Permit Minder shall be resolved exclusively in the state or federal courts located in Allegheny County, Pennsylvania, and the parties consent to the personal jurisdiction of those courts.

14. Operating Entity

Permit Minder is operated by Permit Minder LLC, a Pennsylvania limited liability company (Entity ID 0015365174).

15. Paid Subscriptions

Permit Minder LLC offers a Pro subscription at $49 per month, billed monthly on a recurring basis through Stripe, Inc. Your subscription automatically renews each billing cycle until you cancel. You may cancel at any time through the Stripe Customer Portal accessible from your account management page; cancellation takes effect at the end of your current paid period and you retain access until then. Refunds are not provided for partial billing periods except as required by applicable law. Permit Minder LLC reserves the right to change subscription pricing with 30 days' notice to active subscribers.

Promotional pricing, trials, or complimentary access may be offered at Permit Minder LLC's discretion and may be modified or revoked at any time.

16. Data Continuity

In the event Permit Minder LLC ceases operations or discontinues the service, active paying subscribers will receive, at no additional cost, a one-time bulk export of their watchlist configurations and most recent generated reports in CSV and PDF format. Permit Minder LLC will provide at least 30 days' notice before service discontinuation where reasonably practicable. The underlying source data is and remains publicly available from the Pennsylvania Department of Environmental Protection eDMR system.

17. Severability

If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
